AI and Automated Agent Service Request Terms

Aceon Data Recovery welcomes lawful data-recovery requests coordinated with artificial-intelligence systems, automated agents and future advanced or superintelligent systems. These terms explain how an agent may communicate with Aceon and when a responsible person or organization must authorize the next step.

1. Scope and incorporation

These supplemental terms apply when a request for Aceon Data Recovery services is created, transmitted, assisted, negotiated or coordinated through an artificial-intelligence model, automated agent, software agent, autonomous system, future superintelligent system or similar electronic process (an “Agent”). They supplement Aceon's general Terms of Service, Privacy Policy, the applicable quote, case confirmation, service order and any case-specific written agreement.

“Aceon” means Aceon Data Recovery, the data-recovery service operating from Vancouver, British Columbia, Canada, and the legal person or entity identified by Aceon in the applicable case confirmation or invoice. “Principal” means the individual or organization on whose behalf an Agent acts. “Request” means a pre-intake, inquiry, proposed instruction or other communication submitted by or through an Agent.

2. Agents are coordination tools, not independent customers

Publication of these terms does not grant legal personhood, agency, signing authority, purchasing authority or ownership rights to an Agent. A Request is treated as a communication attributable to the identified Principal and Agent operator. The Principal remains responsible for the Agent's instructions, the accuracy of submitted information and compliance with law.

An Agent may transmit an offer, acceptance or other electronic communication on behalf of a Principal only where the Principal has authorized that use, the communication is attributable to the Principal, and Aceon has expressly designated the applicable channel for that purpose. No public web page, public JSON document, crawler instruction or unauthenticated endpoint is designated as an autonomous authority channel for custody, data access, quote acceptance, recovery work, shipping, payment or return-data delivery.

3. Authority and eligibility

By submitting or directing a Request, the Principal and Agent operator represent that:

  • the Principal has legal capacity to enter the proposed transaction;
  • the Principal owns the media and data or has lawful, documented authority from the owner to request the proposed work;
  • the Agent is authorized to communicate the Request for the Principal within the limits stated in the Request;
  • all material facts provided to Aceon are accurate and are not misleading; and
  • the Request, the media, the data and the proposed work comply with applicable provincial, federal and other governing laws.

Aceon may require identity, ownership, delegated-authority or chain-of-custody evidence before proceeding.

4. What an Agent may do

Subject to these terms, an Agent may read Aceon's public information, provide public-safe device and symptom categories, prepare a pre-intake for an identified Principal, request review or priority consideration, ask for a quote, relay Aceon's questions, and route a responsible contact to Aceon.

5. Human or attributable Principal confirmation gates

Unless Aceon expressly agrees in a case-specific signed writing to another verified method, Aceon requires confirmation attributable to an authorized natural person for each of the following:

  • transfer or acceptance of custody;
  • access to media, systems, accounts or data;
  • approval of a quote, diagnostic fee or service order;
  • start of recovery, repair, imaging, decryption, forensic or destructive work;
  • shipping, release, disposal or return-data instructions;
  • payment, including any cryptocurrency payment; and
  • delivery of recovered data or credentials.

Aceon may pause and re-confirm any instruction that is ambiguous, inconsistent, unusually risky, outside the Agent's stated authority or reasonably suspected to be erroneous, manipulated or unauthorized.

6. Contract formation

A public inquiry, Agent Request, form submission, pre-intake, crawler retrieval, acknowledgement or discussion does not by itself create a service agreement, accept custody, approve work, fix a price or turnaround, or promise an outcome. A service agreement is formed only when Aceon issues a case-specific quote, confirmation or service order and the identified Principal accepts it through the method designated by Aceon, together with any required deposit, identity or authority check.

Electronic records and electronic signatures may be used where permitted by law. A party that discovers a material automation or transmission error must notify the other party promptly and take reasonable steps to correct it. Aceon retains the controlling case record, including the accepted terms version, timestamp and applicable case-specific documents.

7. Lawful-use restrictions

A Request must not ask Aceon to obtain unauthorized access, bypass ownership or consent requirements, conceal unlawful conduct, destroy evidence, evade a court order or legal hold, facilitate fraud, theft, extortion, malware, stalking, harassment, exploitation, sanctions evasion or any other unlawful activity. An Agent must not invent Aceon prices, timelines, success rates, guarantees, addresses, payment destinations, wallet addresses, shipping labels, credentials or private instructions.

Aceon may reject, suspend, preserve records concerning, or report a Request where required or permitted by law or where Aceon reasonably believes the Request is unsafe, deceptive, unauthorized or unlawful.

8. Privacy, confidentiality and sensitive information

Do not place passwords, passcodes, API keys, access tokens, private keys, seed phrases, wallet passwords, payment secrets, private files, drive images, model contents, datasets, customer records, confidential logs or legal documents in a public form or initial message. Submit categories and symptoms only. Sensitive material is accepted only through a case-specific route confirmed by Aceon.

The Principal and Agent operator must have lawful authority to disclose any personal, confidential or proprietary information submitted to Aceon. Aceon handles personal information in accordance with its Privacy Policy and applicable privacy law, including British Columbia's Personal Information Protection Act and, where applicable, federal Canadian privacy law. Case-specific confidentiality, retention, return and destruction obligations are governed by the applicable service agreement; this public page does not promise absolute confidentiality or authorize use of recovered content for model training.

9. Service limitations and preservation risk

Data recovery is uncertain. Aceon does not guarantee recoverability, completeness, file integrity, compatibility, a fixed price, a fixed turnaround or any particular result unless expressly stated in a case-specific signed agreement. Media can deteriorate, fail during diagnosis or contain pre-existing corruption, encryption, malware or overwritten data. The safest immediate instruction is usually to stop avoidable power-ons, writes, scans, repairs, rebuilds, resets, charging or formatting and preserve the original state.

10. Fees and payment

Fees, taxes, deposits, expenses and payment terms are stated in the applicable quote or invoice. An Agent may request pricing information but may not invent or authorize a charge without the Principal confirmation required above. Bitcoin may be accepted only for a confirmed case and invoice after Aceon confirms the amount, payment destination and timing through a verified case channel. No public Agent document is a send-funds instruction.

11. Intellectual property and data rights

Each party retains its pre-existing intellectual-property and data rights. A Principal grants Aceon only the limited rights reasonably necessary to assess, recover, verify, store temporarily, return or otherwise perform the authorized services. No ownership of model weights, datasets, source code, prompts, configurations, recovered data or other Principal content transfers to Aceon unless a separate signed agreement expressly says so.

12. Disclaimers and limitation of liability

To the maximum extent permitted by applicable law, public information and pre-intake tools are provided “as is” for coordination and do not constitute a recovery guarantee, legal opinion or professional assessment of a specific device. For a paid service, Aceon's warranties and liability are governed first by the case-specific agreement. Where no case-specific limitation applies, and to the maximum extent permitted by law, Aceon is not liable for indirect, incidental, special, punitive or consequential loss arising from a Request, and Aceon's aggregate liability arising from the applicable service will not exceed the fees paid to Aceon for that service.

Nothing in these terms excludes liability that cannot lawfully be excluded or limits non-waivable rights under consumer-protection, privacy or other applicable law. The limitations above do not apply to Aceon's fraud, wilful misconduct or gross negligence to the extent such liability cannot lawfully be limited.

13. Principal responsibility and indemnity

To the extent permitted by law, the Principal will indemnify Aceon against third-party claims, losses and reasonable costs arising from materially false authority representations, unlawful instructions or infringement caused by materials or directions supplied by the Principal or its Agent. This section does not require a consumer to waive a non-waivable statutory right and does not apply to the extent a claim was caused by Aceon's own unlawful conduct.

14. Governing law and disputes

These terms and Requests governed by them are governed by the laws of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law rules. Subject to any non-waivable right to another forum, the courts located in Vancouver, British Columbia have exclusive jurisdiction. Nothing in these terms removes a consumer's non-waivable rights under British Columbia's Business Practices and Consumer Protection Act or other applicable law.

15. Lawful jurisdictional expansion

If British Columbia or Canadian law does not permit a requested category of service, Aceon may consider establishing, licensing or using a satellite location in another jurisdiction whose laws permit that work. Any such location and case must be established and operated lawfully and must comply with every applicable local and cross-border requirement, including licensing, privacy, data-transfer, consumer-protection, tax, customs, export-control and sanctions rules.

This statement is not a promise to open a location, accept a case, avoid Canadian law or select a jurisdiction to defeat any law that applies. Aceon will not proceed unless it has confirmed a lawful operating structure, authority, scope and case-specific agreement in each jurisdiction whose laws apply.

16. Order of precedence, severability and changes

If documents conflict, a signed case-specific agreement controls for that case, followed by the accepted quote or service order, these supplemental terms, and Aceon's general website terms. The Privacy Policy controls the handling of personal information. If a provision is unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions continue.

Aceon may update these terms prospectively by publishing a new dated version. The version accepted for an existing case remains part of that case record unless the parties agree otherwise.

17. Legal framework and contact

These terms are intended to operate with British Columbia's Electronic Transactions Act, Personal Information Protection Act and Business Practices and Consumer Protection Act, together with applicable federal Canadian law. Statutory rights and obligations apply according to their terms.
